Unless indicated otherwise, most products and services featured on the site are available directly from or through LaDIFFÉRENCE, Inc. LaDIFFÉRENCE, Inc. has made a conscientious effort to display and describe its products and services on the site accurately so that you can get a good idea of their design and use, and of the services offered. Furthermore, LaDIFFÉRENCE, Inc. is constantly improving its information, products and services. Consequently, LaDIFFÉRENCE, Inc. cannot and does not guarantee the accuracy or completeness of the information, including prices, product images, specifications, availability and services. Products and services are the responsibility of the manufacturer or provider of those services and are covered by the warranties offered by such manufacturers or providers. The prices shown on specific products on our website are checked for accuracy when we post the product on the Internet, and periodically rechecked thereafter. However, vendor pricing changes are frequent in the home furnishings market. Consequently, the price shown on the Internet posting may not reflect the most recent price for the product as offered by LaDIFFÉRENCE.

Prices shown on our website do not include shipping fees. Please call the store for more details and the shipping fees will be decided on a case by case basis.

Shipping Policy

LaDifférence is happy to ship your purchases to your destination. We take every precaution to ensure that the item shipped to you will arrive in good condition.

LaDifférence commitment to the customer:
• We will verify that the merchandise is in good shape from the manufacturer before we ship.
• We will employ only experienced packers and all merchandise is thoroughly checked for hidden damage before being packed and shipped.
• We utilize transportation companies that have demonstrated a commitment to cost effectiveness, timely deliveries and quality service.

Customer's Responsibility:
• You, the customer, must be at home to accept the delivery. If your merchandise is too large or heavy to be shipped by FedEx, it will be shipped by common carrier. If the shipment is to a residential address and involves an inside delivery (this means only that they will set the furniture in your house in the entryway) and/or requires pre-notification, these services can be provided and the fees included in your shipping cost. You must let your salesperson know this before the item is shipped.

• Do not allow the transportation company to leave your delivery on the doorstep.

• Upon arrival, you must check all cartons thoroughly and make sure that no damage has occurred in transit. Inspect the merchandise for damage before signing the delivery receipt. If additional services are required, these must be discussed with your LaDiff salesperson prior to shipping.

• If damage has occurred, make complete notes on the delivery ticket. Save all of the original packaging and call the transportation company to come examine the goods. Make sure to get the signature of the transportation driver with the complete notation of damages.

• If using a common carrier, please be advised that they are not responsible for the removal of any packing materials (including pallets).

• If you, the customer, are unable to accept merchandise at the arranged time, you will be liable and responsible for any and all shipping costs, redelivery fees and/or returned shipping costs.

If the above steps are not followed completely, LaDifférence cannot accept responsibility for damages and/or additional charges.

The transportation company is liable for any damage, no matter how small.

LaDifférence will assist with filing damage claims, as long as the proper procedures have been followed by you.

Price Match Policy

Buying furniture is a big commitment, and the prices at LaDIFFÉRENCE are designed to respect you and the important decision you are about to make. Be assured that we are not in the practice of periodically inflating our prices to create a perception of savings at another time. We value our customers, and you can be assured that our furniture is at the best possible prices each and every day. If you find a lower price* on the same product*, we will attempt to match that price.

Special Orders

SPECIAL ORDERS LEAD TIMES:
Estimated lead times for how long it will take an order to arrive AT THE LaDIFFÉRENCE WAREHOUSE are based on manufacturer's recommendations, order requirements & past history. Lead times begin once deposits are received and customer has signed authorization for the order. LaDIFFÉRENCE, Inc. cannot be held responsible for arrival delays beyond our control including BUT NOT LIMITED to fabric delays, production delays & shipping delays.

DEPOSITS:
Special orders require a minimum non-refundable deposit of 50% at time of order. The balance in full is due and payable at the earlier of: (1) customers’ pickup of merchandise, (2) prior to release of merchandise for delivery or shipment, or (3) within 30 days of notice to customer that merchandise has arrived at LaDIFFÉRENCE (provided that customer has given current contact information and numbers at time of purchase.) Failure to pay in full within 30 days of arrival notice (unless other arrangements have been made with management) may result in automatic cancellation and forfeiture of deposit.

RIGHT TO CANCEL:
Special orders may only be cancelled within 72 hours (3 days) of placement; order will not be placed with vendor before then without customer’s waiver. Refunds on deposits are only available if the manufacturer can no longer provide the item(s) ordered or if the merchandise arrives damaged and CANNOT be repaired or replaced. The cancellation of orders outside of these guidelines will result in the forfeiture of the original 50% deposit. Please select carefully.

IN STOCK PURCHASES:
In stock merchandise must be paid in full at time of purchase, with arrangement for immediate pick-up or delivery.

FINAL SALE PURCHASES:
- All clearance items, whether or not taken, picked up or delivered, are considered final sales on the date of & at the time of purchase & may not be cancelled or returned.
- All special order purchases (See deposit forfeiture notes under ‘special orders’).
- All non-clearance items stored by LaDIFFÉRENCE for a customer for more than 10 days. (Also see Storage)
- Any item that has been altered in any way by the customer or at the request of the customer.
- Any item that has been actively used, endured misuse or has had a repair attempted that was not authorized by LaDIFFÉRENCE.
- All performed services: Delivery, assembly, fabric & leather protection, shipping costs, repair services.
- All bedding (mattresses, bed pillows, bed linens, and sleeper sofas) is non-returnable under any circumstances by state law.

RETURNS:
Not all items purchased are eligible for return, exchange, or refund. For example, clearance items may not be returned or exchanged. For all returns, the original LaDIFFÉRENCE sales invoice must be presented at time of return. In addition, there are 2 general policies:

1. Regular stock merchandise taken in manufacturers’ packaging that is picked up (or taken) by the customer may be returned in the original packaging, with all instructions and parts, in re-sellable condition, within 10 days of date of purchase. Please note: most items that have been assembled cannot and should not be disassembled for return. Items will be inspected upon return.

2. Non-Clearance floor models and items purposefully taken without the original packaging may be returned in the same re-sellable condition as taken within 3 days of purchase to avoid a restocking fee.

Storage

NON-clearance items stored (awaiting pick up or delivery) by LaDifference, Inc, for more than 30 days are subject to a storage fee of 5% of the original purchase price per month thereafter. Clearance items stored by LaDifference, Inc. become the property of the purchaser upon purchase, and after 30 days are subject to a storage fee of 5% of the original purchase price per month thereafter. Unless special arrangements are made, your failure to pick up or have delivered any item stored for more than 3 months will constitute rejection of the items and repudiation with respect to the items stored, entitling LaDIFFÉRENCE to pursue its lawful remedies, including the remedies of § 8.2-703 of the Code of Virginia.

Refunds (Provided all terms acceptable for return are met)

- Purchases made by credit card will be refunded to the original credit card.
- Purchases under $20 made by check written more than 10 days prior or made by cash will be refunded by cash.
- Purchases over $20 made by check written within 10 days or made by cash will be refunded by company check, made out to and mailed to the original purchaser within 10 days of the return.
- Purchases made by store credit or gift certificate will be refunded as a store credit, valid for one year from return date.
- Purchases made by LaDIFF endorsed, private label finance plan will be refunded to same plan on the applicant’s behalf.

EXCHANGES (STORE CREDIT):
Only items purchased at LaDIFFÉRENCE may be returned to LaDIFFÉRENCE. If a sales invoice is not presented, or if someone other than the original buyer makes a return, a store credit, valid for 1 year from the return date, may be given for items returned in the original packaging in re-sellable condition. (LaDIFF staff members have the right to verify pricing & dates with records. If pricing cannot be verified, the value of the item will be its lowest price sold in the past 30 days.) Returns for items purchased prior to 10 days - with or without receipt - may be returned at the sole discretion of management, for store credit only.

Other Provisions

RE-STOCKING & OTHER FEES:
Merchandise that has been delivered may be returned at the sole discretion of LaDIFFÉRENCE. The customer will forfeit the original delivery fee and will incur a pick-up fee equal to the delivery fee for his/her neighborhood. Furniture items purchased new, but returned without the original packaging, will be accepted at the sole discretion of LaDIFFÉRENCE. A minimum 15% re-stocking fee will be assessed. Items assembled by or for a customer may be returned at the sole discretion of LaDIFFÉRENCE and will incur a minimum 25% restocking fee & a forfeiture of any original assembly charges paid. Most items that have been assembled cannot and should not be disassembled for return. Please note, items returned without the original packaging can no longer be sold at regular prices; the restocking fee accommodates the need to discount for reduced sale.

NOTICE:
Any notice that may be given to the customer in connection with this order will be effective when sent by first class mail to the address set forth on the reverse side of this invoice.

RECOURSE:
If legal action or efforts are deemed necessary to enforce LaDIFF’s rights, customer will be liable for all fees, costs and expenses related to such action or efforts including reasonable attorney’s fees.

WARRANTY:All items sold only carry any manufacturer’s warranty that might apply. Warranties vary from manufacturer to manufacturer. Please ask for specifics about the products you purchase. Customer is responsible for all costs to return items requiring warranty repair work or replacement. Customer is responsible for maintaining receipts and other documents required to verify purchase for any warranty claims. All clearance items are sold AS IS, WHERE IS, WITH ALL FAULTS, and without any warranty, express or implied, by LaDIFFÉRENCE, including the IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL LaDIFFÉRENCE BE LIABLE FOR ANY LOST OR ANTICIPATED PROFITS, OR ANY INCIDENTAL, EXEMPLARY, SPECIAL, OR CONSEQUENTIAL DAMAGES, REGARDLESS OF WHETHER LaDIFFÉRENCE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL LaDIFF’S TOTAL LIABILITY FOR DIRECT DAMAGES UNDER ANY THEORY OF RECOVERY EXCEED THE AGGREGATE AMOUNT PAID TO IT HEREUNDER.

Privacy Policy

We want to assure you that the information you provide LaDIFFÉRENCE remains private. LaDIFFÉRENCE does not sell, lease, or give away customer information from our mailing or e-mailing list files for the purpose of solicitation by other companies. From time to time, we do participate in carefully selected joint direct mailings with our vendors, but LaDIFFÉRENCE retains control of the customer information under confidentiality agreements.

Legal Jurisdiction

Legal jurisdiction for any legal actions involving LaDIFFÉRENCE must be in the courts of the City of Richmond in Virginia, USA.

The user of the LaDIFFÉRENCE website assumes all responsibility and risk for the use of this site, and the internet in general.
